1.0 Introduction
123RF has 3 agreements that you may need to understand and agree to abide by before you submit content to us:
These 3 agreements were designed specifically to outline the obligations and relationships of the transacting parties – You and 123RF. From the agreements you can also draw some conclusions on the Do’s and Don’ts of content contribution.
Please make sure you understand them thoroughly before you start submitting your content to 123RF.
2.0 General Terms of Being a Contributor at 123RF
Below are some of the terms that are universal throughout all the Contributor Agreements at 123RF.com.
2.1 On the Qualifications of Becoming a Contributor
At least 18 years old.
This is a requirement for legal purposes as you must have reached the age of majority in order to enter into a contractual agreement.
You have a Goverment Issued Identification.
Government Issued Identification is an important document for us we need to verify your age as well as for payment purposes. We can accept the following methods of identification:
Passports
National Identity Cards
Driving License
Company incorporation documents
Copyright of Content Submitted
You own the copyrights to the Content that you are submitting to us.
You are allowed to distribute the Content that you are submitting to us.
Accuracy of the Information in Model and Property Releases
If your Content has a recognizable face or a distinct piece of property, we require Model or Property releases from you.
You warrant that all information contained in any release that you send to us are accurate and that you have obtained all permissions as stated in the release beforehand and through legal means.
2.2 On Getting Paid
All payments are made in US Dollars.
123RF offers 3 type(s) of payment method: Paypal, Moneybookers and Cheque.
minimum payout Rates are as below:-
PayPal (minimum payout is $50)
Moneybookers (minimum payout is $100)
Cheque (minimum payout is $200)
Commision levels will be recognized as depicted in the Contributor’s Commission Structure.
2.3 On the Rights of Licensing and Distribution
You appoint 123RF as a distributor to distribute and license your content on a non-exclusive worldwide basis terms.
You also give permission to 123RF to distribute and market your Content at all channels and partners that we deem fit to carry your Content.
2.4 On Content Handling and Account Governance
Regardless of the content that you’re sending to us, you give 123RF the absolute right to accept, refuse to accept, store, archive, backup, remove or delete content that you have uploaded to us.
If we find that you have violated any terms and conditions within the various Contributor’s Agreements, we will conduct an investigation and may:
suspend;
termporarily freeze;
remove your portfolio from online sale; and/or
freeze any due payments or forfeit any unpaid payments due to you indefinitely
until the matter is resolved to our sastisfaction.
2.5 On Privacy
We will not share or divulge any information that can be classified as of a personal nature to any one who has not been authorized to handle that information. This information can be in the form of:
Your contact information
Your email address
Your Paypal or Moneybookers email address
Information contained within the Model or Property Releases
3.0 Understanding the Various Contributor Agreements
3.1 123RF.COM Content Contributor Agreement
This is the agreement:

Make sure the copyrights to the content (image, vector illustration, footage) belong to you “the respective Contributor”.
The content (image, vector illustration, footage) that you are submitting to be sold under Commercial Royalty Free license are absent of any trademarks and logos.
Your content is FREE from any infringement of copyright, trademark, intellectual property rights or violate the privacy of any party.
Your Content (image, vector illustration, footage) have proper and valid Model Releases for Content containing identifiable faces.
Your Content (image, vector illustration, footage) have proper and valid Property Releases for Content that require a Property Release.
Your Content (image, vector illustration, footage) does not involve any sensitive subject matters such as pornographic, offensive, political, racist, ethnically or culturally offensive, obscene or indecent, sexually explicit, immoral, defamatory, intrusive towards privacy, or illegal in nature; or which endorses violence or acts of terrorism, is discriminatory towards race, gender, religion, faith, or sexual orientation, or which purports to endorse products or services carrying sensitive mental/health connotations.
All registration information, documents and identification (collectively,”Contributor Info”) provided are true, accurate, up to date and not misleading.

DO NOT submit any content (image, vector illustration, footage) that does not belongs to you.
DO NOT submit any content (image, vector illustration, footage) that may infringe any copyright, trademark, intellectual property rights or privacy of any party.
DO NOT submit any content (image, vector illustration, footage) deem to involve sensitive subject matters such as pornographic, offensive, political, racist, ethnically or culturally offensive, obscene or indecent, sexually explicit, immoral, defamatory, intrusive towards privacy, or illegal in nature; or which endorses violence or acts of terrorism, is discriminatory towards race, gender, religion, faith, or sexual orientation, or which purports to endorse products or services carrying sensitive mental/health connotations.
3.2 123RF Audio Contributor Agreement
This is the agreement:
Please make sure that you are NOT a member of any Collection Society, if you are a member of any Collection Society, you may not contribute to 123RF.com.
We are not able to remit or pay any commissions to any Collection Society.
Do’s
Make sure your Audio Content in any way and in any territory worldwide is FREE from any, infringement of copyright, trademark, intellectual property rights, performer’s rights, audio / voice release rights, production rights, privacy rights, publicity rights, trade secret, confidentiality or any other proprietary right of any party or third party (“IPR”).
Make sure your Audio Content is FREE from any element that involves sensitive subject matters such as pornographic, offensive, political, racist, ethnically or culturally offensive, obscene or indecent, sexually explicit, immoral, defamatory, intrusive towards privacy, or illegal in nature; or which endorses violence or acts of terrorism, is discriminatory towards race, gender, religion, faith, or sexual orientation, or which purports to endorse products or services carrying sensitive mental/health connotations.
Your submitted Audio Content shall have “Audio Release” and when requested by 123RF, you “the respective Contributor” shall prove the “Audio Release” and the information in the “Audio Release” MUST be relevant, valid, true and accurate in relation to the Audio Content uploaded by You.

DO NOT submit any audio content that does not belongs to you.
DO NOT submit any audio content that belongs to any member of any collection society.
DO NOT submit any Audio Content that is deemed to be sensitive in subject matters such as pornographic, offensive, political, racist, ethnically or culturally offensive, obscene or indecent, sexually explicit, immoral, defamatory, intrusive towards privacy, or illegal; or which endorses violence or acts of terrorism, is discriminatory towards race, gender, religion, faith, or sexual orientation, or which purports to endorse products or services carrying sensitive mental/health connotations.
3.3 123RF Exclusive Logo Contributors Agreement

Before you send your exclusive to 123RF.com, please make sure that your exclusive logo submissions abide by the following requirements:
The Logos that you produce MUST NOT be sold under any Royalty-Free license.
If you wish to contribute to this section, please bear in mind that these logos are for sale only on AN EXCLUSIVE basis! Consider these 3 scenarios:

Make sure the copyrights to the logo illustration are your original work and design.
The logo illustration submitted by you is FREE from any commercial or any editorial usage previously or currently.
Make sure the logo illustration you submitted is FREE from any any manner that violates, plagiarizes, misappropriates or infringes the rights of third parties including, without limitation, copyright, trademark rights, rights of privacy or publicity, performance rights, confidential information or any other right.
Make sure your logo illustration you contribute or submitted is FREE from any element that involves sensitive subject matters such as pornographic, offensive, political, racist, ethnically or culturally offensive, obscene or indecent, sexually explicit, immoral, defamatory, intrusive towards privacy, or illegal in nature; or which endorses violence or acts of terrorism, is discriminatory towards race, gender, religion, faith, or sexual orientation, or which purports to endorse products or services carrying sensitive mental/health connotations.
Your submitted logo illustration shall have “Logo Release” and when requested by 123RF, you “the respective Contributor” shall prove the “Logo Release” and the information in the “Logo Release” MUST be relevant, valid, true and accurate (including, without limitation, for design copyright, trademark or service mark reasons) in relation to the Logo(s) Uploaded by You.

DO NOT submit any logo illustration that does not originated from you.
DO NOT contribute or Upload any Logo in any manner that violates, plagiarizes, misappropriates or infringes the rights of third parties including, without limitation, copyright, trademark rights, rights of privacy or publicity, performance rights, confidential information or any other right.
DO NOT submit any logo illustration that is deemed to involve sensitive in subject matters such as pornographic, offensive, political, racist, ethnically or culturally offensive, obscene or indecent, sexually explicit, immoral, defamatory, intrusive towards privacy, or illegal; or which endorses violence or acts of terrorism, is discriminatory towards race, gender, religion, faith, or sexual orientation, or which purports to endorse products or services carrying sensitive mental/health connotations.
4.0 Violation
If 123RF found that your account is abusing or violating any clause of the agreement, 123RF reserves the rights to:-
remove any previously accepted Content for any reason whatsoever
terminated your account and reserves the right to off-set, forfeit or freeze any part or all commissions due to any violation in any of 123RF contributor’s agreement.
flag any contributor for permanent lifetime ban and block any re-register as contributor in 123RF.
You may appeal for an account clearance by sending your apeal to submission@123rf.com if the violation is unintentionally. BUT once your appeal were to be found untruthful, violator will result in permanent lifetime ban from contributing in 123RF.
